Temporary Work Abroad for Dutch Employees

When a Dutch employer intends to temporarily assign an employee to work outside the Netherlands, specific regulations come into play to ensure proper social insurance coverage. In most cases, the Dutch social insurance system will continue to cover the employee, even during their temporary work abroad. This arrangement exempts the employer from making social insurance contributions in the foreign host country. However, it’s essential to obtain an A1 certificate (replacing the former E101 certificate) to facilitate this process.

Understanding the A1 Certificate

The A1 certificate is a crucial document that designates the country responsible for an employee’s social security coverage. This certificate holds validity within the European Economic Area (EEA) and in nations with which the Netherlands maintains social security agreements. Many countries require an A1 certificate validation, checked by their respective labor inspectorate. The certificate application should be submitted to the social insurance institution of the employer’s home country. The foreign institution’s provided certificate then guides the Dutch employer’s compliance.

A Crucial Choice

Neglecting to apply for an A1 certificate leads to the application of the default insurance rule. In simpler terms, the employee becomes subject to the social security laws of the host country where they’ll be temporarily working. This shift applies particularly to situations where an A1 certificate hasn’t been obtained.

Flexibility in Application

While the general practice involves obtaining an A1 certificate in advance from the competent institution, there are exceptions. For instance, hastily planned business trips or short-term assignments lasting up to a week might warrant skipping the A1 certificate application process.

Certificate Duration and Extension

Typically, an A1 certificate remains valid for 24 months. However, upon request, it can be extended for successive 12-month periods. This extension serves to accommodate longer temporary work assignments while upholding the benefits and coverage provided under the Dutch social insurance system.
